I believe the only reason we need tail tidies is the EU rule that the most rearwood thing on the bike is not allowed to be the tyre and your rear fender achieves that requirement so I would say counts as legal!

Not sure about Portugal, visited lots but not ridden bikes there (yet) but in the UK any lid must be secure! If you can demonstrate that whatever you have bungeed on is properly secure and there is no reasonable way it could part company with the bike that would not be an offence!
